Welcome to DOST.

These Terms of Service govern the use of the DOST online store and website and the purchase of products offered through it.

The terms "we", "us" and "our" refer to DOST, operated by D'Ostuni Simone, an individual business registered in Italy.

DOST operates this store and website, including all related information, content, features, tools, products and services in order to provide customers with our Services. Our online store is powered by Shopify.

By visiting, interacting with or using our Services, and/or purchasing a product from us, you agree to these Terms of Service together with the policies referenced on this website, including our Privacy Policy, Shipping Policy and Refund Policy.

Nothing in these Terms limits or excludes any mandatory rights granted to consumers under applicable Italian or European Union consumer protection law.

If you do not agree to these Terms, you should not use our Services.

SECTION 1 - ACCESS AND ACCOUNT

You must be at least the age of majority applicable in your country of residence, or otherwise have the authorization of a parent or legal guardian where required by law, to make purchases through our store.

When using our Services or placing an order, you may be required to provide information including your name, email address, billing address, shipping address and payment information.

You agree that the information you provide is accurate, current and complete.

You are responsible for maintaining the confidentiality and security of your account credentials and for activities performed through your account.

SECTION 2 - OUR PRODUCTS

DOST creates handmade metal fashion accessories and wearable pieces.

Due to the handmade nature of our products, slight variations between individual pieces may occur. These variations are part of the artisanal production process and do not necessarily constitute a defect or lack of conformity.

We make every reasonable effort to display product colours, materials, dimensions and appearance accurately. However, colours and appearance may vary slightly depending on lighting, photography, screen settings and the device used to view our website.

Product descriptions, photographs, measurements and other information are provided to help customers understand the characteristics of each item.

We reserve the right to modify or discontinue products and collections, subject to orders already accepted by us and to applicable law.

Availability may be limited due to the handmade nature of our production.

SECTION 3 - HANDMADE, MADE-TO-ORDER AND CUSTOM PRODUCTS

Certain DOST pieces may be handmade after an order is placed, made to order, produced according to measurements supplied by the customer, or customized according to specifications selected or requested by the customer.

Estimated production times, where applicable, are indicated on the relevant product page or communicated to the customer.

Production times and shipping times are separate.

Customers are responsible for providing accurate measurements and customization information when requested.

For products made according to the consumer's specifications or clearly personalized, the statutory right of withdrawal may not apply, in accordance with applicable consumer protection law.

This exception does not affect the customer's rights where a product is defective, damaged, or does not conform to the contract.

SECTION 4 - ORDERS

By placing an order, you submit an offer to purchase the selected products.

After an order is submitted, you may receive an automatic confirmation acknowledging receipt of your order.

We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of product unavailability, incorrect pricing, suspected fraud, payment problems, or errors in product information.

If we cancel an order after payment has been received, the amount paid for the cancelled order will be refunded.

Once production of a made-to-order or personalized item has started, cancellation may no longer be possible where permitted by applicable law.

Please carefully check all order information, including shipping address, measurements, colours and customization choices, before completing your purchase.

SECTION 5 - PRICES, TAXES AND PAYMENT

All prices displayed on the website are shown in the currency indicated at checkout.

Taxes will be applied in accordance with applicable law and the customer's destination where relevant.

Shipping costs, where applicable, are displayed before the customer completes the order.

For international orders delivered outside the European Union, customs duties, import taxes, brokerage fees or other charges may be imposed by the destination country.

Unless expressly stated otherwise at checkout, such import charges are not included in the product price or shipping price and are the responsibility of the recipient.

We have no control over customs charges imposed by foreign authorities.

Customers are responsible for providing accurate billing and payment information.

SECTION 6 - SHIPPING AND DELIVERY

We ship orders to the destinations indicated on our website and during checkout.

Estimated production and delivery times are provided for information purposes. Delivery times may be affected by the destination, carrier, customs procedures and circumstances outside our reasonable control.

For sales to consumers where mandatory consumer protection rules apply, risk of loss or damage remains with DOST until the customer, or a third party designated by the customer other than the carrier, physically receives the goods, except where the customer independently commissions a carrier not offered by us, as provided by applicable law.

If a shipment appears to be lost, damaged or significantly delayed, please contact us at dost.armor@gmail.com so that we can investigate the issue with the carrier.

International shipments may be subject to customs processing, which can increase delivery times.

SECTION 7 - RETURNS AND RIGHT OF WITHDRAWAL

Consumers who purchase online may have a statutory right to withdraw from the purchase within 14 days from the date on which they, or a third party designated by them, receive the goods, without having to provide a reason, where required by applicable law.

The conditions and procedure for exercising this right are described in our Refund Policy.

Unless otherwise required by law or agreed by DOST, the direct cost of returning a product following a change-of-mind withdrawal is borne by the customer.

The statutory right of withdrawal does not apply in the cases provided by applicable law, including, in particular, goods made to the consumer's specifications or clearly personalized.

Therefore, pieces produced specifically according to a customer's individual measurements, modifications or personalized specifications may not be eligible for change-of-mind returns.

The exclusion of the right of withdrawal does not limit the customer's rights regarding defective, damaged or non-conforming goods.

SECTION 8 - LEGAL GUARANTEE AND PRODUCT CONFORMITY

Consumers located in the European Union benefit from the mandatory legal guarantee of conformity provided by applicable consumer protection legislation.

For new goods, the legal guarantee generally applies for two years from delivery, in accordance with applicable law.

A product must correspond to its description and possess the quality, characteristics and functionality that the customer may reasonably expect, taking into account its nature and the information provided before purchase.

Where a product has a lack of conformity covered by the legal guarantee, the consumer is entitled to the remedies provided by applicable law, which may include repair or replacement and, where the legal requirements are met, an appropriate price reduction or termination of the contract.

Normal wear and tear, accidental damage, misuse, improper storage, improper maintenance or damage caused by alterations made by the customer are not manufacturing defects.

The handmade nature of DOST products may result in minor variations between individual pieces. Such variations do not constitute a lack of conformity where they are consistent with the product's handmade nature and with the description and information provided before purchase.

Nothing in these Terms excludes or restricts mandatory legal guarantee rights.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

DOST is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases you make in our Store are made directly with DOST.

By using the Services, you acknowledge and agree that Shopify is not the seller of DOST products and is not responsible for the performance of the sales contract between you and DOST, except to the extent otherwise required by applicable law.

SECTION 10 - INTELLECTUAL PROPERTY

Unless otherwise indicated, the content of the DOST website, including photographs, product designs, graphics, logos, text, videos, branding, collection names and other original content, belongs to DOST or is used under appropriate authorization.

Such content is protected by applicable intellectual property laws.

You may access and use the website for personal and non-commercial purposes.

You may not reproduce, distribute, sell, commercially exploit, modify or republish our protected content without prior written permission, except where permitted by applicable law.

DOST names, logos, original designs and distinctive brand elements may not be used in a way that suggests affiliation, endorsement or authorization without our prior permission.

Shopify's trademarks and intellectual property remain the property of Shopify and its respective rights holders.

SECTION 11 - THIRD-PARTY SERVICES AND LINKS

Our website may contain links, integrations or tools provided by third parties.

We are not responsible for the content, availability or practices of independent third-party websites or services.

Before using a third-party service or completing a transaction with a third party, you should review its applicable terms and privacy policies.

Nothing in this section limits any responsibility that cannot legally be excluded.

SECTION 12 - PRIVACY

Personal information collected through our Services is processed in accordance with our Privacy Policy and applicable data protection legislation.

Because our store is hosted by Shopify, certain personal information may also be processed by Shopify in connection with the operation of the ecommerce platform.

SECTION 13 - REVIEWS, FEEDBACK AND USER CONTENT

If you voluntarily submit reviews, photographs, comments or other content to us, you confirm that you have the necessary rights to submit that content.

You must not submit unlawful, defamatory, infringing, misleading, abusive or malicious content.

Where you expressly authorize us to use customer photographs, reviews or other submitted material for promotional purposes, such use will be subject to the authorization granted and applicable law.

Nothing in these Terms transfers ownership of your original content to DOST unless expressly agreed.

SECTION 14 - ERRORS AND INACCURACIES

We make reasonable efforts to ensure that information on our website is accurate.

Occasionally, product descriptions, prices, availability, shipping information or other content may contain typographical errors or inaccuracies.

We reserve the right to correct errors and update information.

If an error materially affects an order that has already been placed, we will contact the customer where appropriate and apply the remedies required by applicable law.

SECTION 15 - PROHIBITED USES

You may use our website only for lawful purposes.

You may not use the Services to:

- violate applicable laws or regulations;
- infringe intellectual property or other rights;
- transmit malicious software;
- attempt unauthorized access to our systems;
- collect personal information unlawfully;

To the extent permitted by applicable law, DOST is not responsible for indirect losses that were not reasonably foreseeable at the time the contract was concluded or for losses resulting from circumstances outside our reasonable control.

We are not responsible for damage caused by improper use, alteration, misuse or failure to follow product care instructions.

Any limitation contained in these Terms applies only to the extent permitted by mandatory applicable law.

SECTION 17 - PRODUCT USE AND CARE

DOST products are fashion accessories and wearable artistic pieces unless a product description expressly states otherwise.

They are not protective equipment, personal protective equipment, safety equipment, combat equipment or medical devices.

Metal components may require appropriate care to preserve their appearance and structure.

Customers should follow any care, storage and use instructions provided with the product or on our website.

Products should not be used for purposes other than those reasonably intended according to their description.

SECTION 18 - EVENTS OUTSIDE OUR CONTROL

We will not be responsible for delays or failure to perform obligations where such delay or failure results from circumstances outside our reasonable control, including natural disasters, transportation disruptions, customs delays, strikes, governmental measures, supply disruptions or other force majeure events.

This provision does not affect mandatory consumer rights.

SECTION 19 - SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will apply to the maximum extent permitted by law or, where necessary, will be considered severed.

The remaining provisions will continue to remain in effect.

SECTION 20 - NO WAIVER

If we do not immediately exercise a right or remedy available under these Terms or applicable law, this does not constitute a waiver of that right or remedy.

SECTION 21 - ENTIRE AGREEMENT

These Terms, together with the policies expressly incorporated or referenced herein, constitute the agreement governing use of our Services and purchases made through our online store, without prejudice to mandatory rights arising under applicable law.

SECTION 22 - GOVERNING LAW AND CONSUMER RIGHTS

These Terms and contracts concluded through the DOST online store are governed by Italian law, without prejudice to any mandatory consumer protection provisions applicable to consumers under the law of their country of habitual residence.

For consumers, any dispute shall be subject to the competent court determined under applicable mandatory consumer protection and jurisdiction rules.

Nothing in these Terms deprives a consumer of protections that cannot be waived or restricted by contract.

SECTION 23 - CHANGES TO THESE TERMS

We may update these Terms of Service from time to time, including to reflect changes to our Services, business practices or applicable legal requirements.

The current version will be published on this website.

Material changes will be communicated where required by applicable law.

Changes will not retroactively reduce rights already acquired in relation to orders concluded before the relevant changes became effective, except where permitted or required by law.
